TERMS AND CONDITIONS
Applicable to all guests upon making a reservation.


• PAYMENT AND CONFIRMATION OF RESERVATION
As soon as PORTO HAVEN confirms that the pre-payment of the reservation has been made, it will send a reservation confirmation to the email address specified by the GUEST at the moment of booking the accommodation in question.


• ALTERATION OF RESERVATION DATES OR NUMBER OF GUESTS
It is the GUEST's responsibility to report any changes to the reservation's dates or number of guests up to 5 days (when applicable) before the check-in date. Meanwhile, PORTO HAVEN will make all reasonable efforts to accommodate the changes, knowing that all requests are always subject to availability and applicable price differences.


• CANCELLATION OF RESERVATION
Reservations can be cancelled free of charge (100% refund of the amount paid at the time of booking) up to 5 days before the GUEST's check-in date. Any cancellation made after this period will incur a charge of 100% of the reservation value.


• CITY TOURIST TAX
A city tourist tax, that PORTO HAVEN is legally bound to charge its GUEST on behalf of the Portuguese municipal authorities, will be included in the overall price of the reservation at the moment the reservation.
If, for any reason, the GUEST was not charged this tax at the time of booking the accommodation, he must pay it until 2 days before the check-in date.


• SECURITY DEPOSIT
Before the check-in instructions for the accommodation in question can be sent by PORTO HAVEN, the GUEST must pay the security deposit indicated at the time of booking.
The purpose of the security deposit is to guarantee the return of the accommodation and its contents in the same condition as when it was delivered to the GUEST. The deposit will be refunded in full within 7 days of check-out, provided that the condition of the apartment and its contents is the same as at the time of delivery.


• ARRIVAL AND CHECK-IN TIME
Unless otherwise agreed, check-in will be after 4:00 PM.


• CHECK-IN INSTRUCTIONS
Porto Haven shall send the GUEST an email detailing the accommodation's check-in instructions 2 days before the GUEST check-in date, as long as, by that time, a security deposit and city tourist tax has been paid by the GUEST and the GUEST has filled and submitted the online check-in form sent by email by Porto Haven at the time of the booking confirmation.


• CHECK-IN METHOD
Following the digital trend of hassle-free check-in, all of our accommodations allow you to self-check-in either by using self-collected keys or by using PIN codes.


• ACCOMMODATION KEYS
One set and only one set of keys will be provided at check-in (please disregard in case the check-in method is based on using PIN codes). If for some reason the GUEST loses or damages, beyond repair, the accommodation keys, the GUEST will be charged 20€ per set of keys.


• DEPARTURE AND CHECK-OUT TIME
Unless otherwise agreed, check-out will be until 11:00 AM. If the GUEST does not leave the apartment by 11:00 AM, PORTO HAVEN reserves the right to charge an additional night as a penalty.


• CHECK-OUT INSTRUCTIONS
The GUEST is required to leave the accommodation keys (when applicable) where he originally collected them from, as well as leave the kitchenware and tableware washed and cleaned before he checks-out from the accommodation.
Additionally, he is required to leave all the windows and the accommodation entrance door closed, as well as turn off all the existing lights and electrical appliances (eg: air conditioning, TV, stove).


• AMENITIES/CONSUMABLES
PORTO HAVEN will provide, for the first days of a reservation, the basic amenities/consumables for the GUEST's stay: shower gel, shampoo, liquid soap, toilet paper, kitchen absorbent paper, dishwashing products, laundry washing products (when applicable) and trash bags.
In addition to the above, PORTO HAVEN will provide, as a welcome gift to its' GUEST(s), coffee capsules and tea bags to be used during the first day of the reservation.
No other amenities/consumables will be provided by PORTO HAVEN besides the ones specifically mentioned above for the first days of a GUEST's reservation.


• CLEANING
The accommodations will be cleaned before the GUEST's arrival. PORTO HAVEN’s basic service includes a set of towels (1 face towel and 1 bath towel per guest), bed linen, and some hygiene items for each reservation.
Additional cleaning services and products, including changes of sheets and towels, are available for an additional fee.


• ACCOMMODATION RULES
1. No parties or group events of any kind are permitted in PORTO HAVEN's accommodations. Knowing that PORTO HAVEN reserves the right to require the GUEST to immediately leave the accommodation without any compensation or refund of fees paid if any parties or events are found to be occuring at the accommodation.


2. The GUEST whose name is on the booking confirmation email will be responsible for the behaviour of the entire group and agrees to avoid all illegal activity.


3. The GUEST shall keep any noise to the bare minimum between the, legally enforced, quiet hours' period that goes from 11:00 PM to 7:00 AM.


4. No pets (of any breed, size, or age) are allowed in PORTO HAVEN's accommodations. Knowing that PORTO HAVEN reserves the right to require the GUEST to immediately leave the accommodation without any compensation or refund of fees paid if any pets are found inside.


5. Smoking is strictly prohibited inside all PORTO HAVEN'S accommodations.


6. All items initially found in the apartment belong to the accommodations' owners and should not be moved, altered or removed from the accommodations during the stay.


7. Commercial photography of the accommodations is strictly prohibited.


8. The GUEST is primarily responsible for his own safety during his stay with PORTO HAVEN. To help him do just that, the GUEST should follow any instructions or explanations provided by PORTO HAVEN before, during and after check-in.


9. If the GUEST becomes aware of something during his stay that he believes to be a health and safety risk, he should immediately inform PORTO HAVEN.


10. The GUEST must facilitate access to the accommodation for PORTO HAVEN during their stay, if an unexpected and urgent intervention/repair is required and assuming that the GUEST is notified beforehand by PORTO HAVEN of the need to do it and when it shall be done.


11. When checking-out of the accommodation, the GUEST should ensure he leaves all electrical appliances off (eg: air conditioning, TV, stove), windows closed and lights turned off.


• DAMAGE CAUSED TO THE ACCOMMODATION AND ITS CONTENTS
 The GUEST is responsible for any damage caused to the accommodations or its contents (including linen), as well as to the common areas of the buildings, whether caused by him or his companions during the reservation.
If the value of the damages caused by the GUEST, or by his companions, exceeds the amount of the security deposit, PORTO HAVEN has the express authorization of the GUEST to charge him the necessary amount to repair the damages caused, using the credit card used to pay the security deposit.


• PERSONAL BELONGINGS LEFT IN THE ACCOMMODATION
PORTO HAVEN is not responsible for any objects or personal belongings left in the flat during your stay.
Any item left in the flat after the GUEST check-out will be stored and may be claimed by the GUEST within a maximum period of 14 days. This, knowing that a processing fee plus shipping costs may be applied.


• LEGAL RESPONSABILITIES
1. PORTO HAVEN's service is legally limited to the accommodations and the relationship with the GUEST during his stay. PORTO HAVEN is not responsible for any occurrences outside the accommodations boundaries, such as (but not limited to): building cleanliness and maintenance, external noise, external construction activities, neighbours' behaviours, or any other matter not directly related to the accommodations themselves.


2. The photos and descriptions of the accommodations are produced by PORTO HAVEN and have been reviewed by the owners. Small changes to the accommodations may occur concerning the photos on the website, without compromising its general condition or amenities.


3. PORTO HAVEN will not refund any fees, compensate or transfer the GUEST to another accommodation based on the accommodations' appearance or surroundings. It is the GUEST's responsibility to ensure, before booking the accommodation in question, that the area or neighbourhood he chooses to stay in is to his liking.


4. PORTO HAVEN is not responsible for any damage caused, directly or indirectly, that may occur during the GUEST's stay in the accommodation, such as (but not limited to): personal injury, theft or criminal behaviour, losses due to fire or misconduct, etc.


5. PORTO HAVEN is not responsible for any deficiencies in the supply, by third-parties, of electricity, hot water, or internet, of which PORTO HAVEN is not directly responsible for.


6. PORTO HAVEN is not responsible for potential delays, accidents, losses, or schedule/fare changes related to services provived by THIRD-PARTY suppliers, even though these might have been directly recommended by PORTO HAVEN.


7. PORTO HAVEN is not responsible for errors, omissions or false statements made by any THIRD-PARTY, as well as for any disputes that occur between the GUEST and a THIRD-PARTY, or for the content of external links other than the one where the reservation was made.


8. In the event the GUEST does not comply with these terms and conditions, or in case of misbehaviour by the GUEST, PORTO HAVEN reserves the right to require him to leave the apartment without any compensation or refund of fees paid.


• UNUSUAL SITUATIONS AND LEGISLATION
 1. This agreement is between the GUEST and the company PORTO HAVEN, which is duly authorized to provide the accommodations' rental. This agreement is a license to occupy one or more of the accommodations during the agreed period. The GUEST is not a tenant of the accommodation(s) and does not have exclusive possession of it.


2. In the rare event of a reserved accommodation becoming unavailable due to force majeure events such as unexpected technical failures, natural disasters, riots, and acts of God, or any circumstance beyond the control of PORTO HAVEN, PORTO HAVEN will not be responsible for the inconvenience caused, however, it will take all the necessary steps to move the GUEST to an accommodation of equal or superior characteristics, at no additional cost to the GUEST.
If the GUEST does not accept the proposed change, the full amount (excluding costs related to the days on which the accommodation(s) was used by the GUEST, if applicable) will be refunded, but neither the owner nor PORTO HAVEN will be liable to the GUEST for any additional costs incurred by the GUEST as a result of such cancellation, nor for the possible loss or theft of any objects, belonguing to the GUEST, left behind in the accommodation(s) by the GUEST.


• ABOUT THE TERMS AND CONDITIONS
PORTO HAVEN reserves the right to update its terms and conditions at any time, as necessary. It is the responsibility of the parties using the PORTO HAVEN service to review these terms and conditions in the event of a change before making a reservation.
By agreeing to use the PORTO HAVEN service, it is understood that the guest accepts any changes and that all parties will comply with those changes.
These terms and conditions do not affect the GUEST's rights.


• APPLICABLE LAW
These conditions are subject to the Portuguese law and shall be made to uphold, if necessary, by resorting to The Portuguese Courts.
